As ON Media Studio ("Agency"), we attach great importance to the security and privacy of your personal data. In accordance with the Law on the Protection of Personal Data No. 6698 ("KVKK" / Turkish PDPL), we process your personal data as the "Data Controller" within the framework described below and in compliance with applicable legislation.
1. Data Controller
Your personal data is processed by ON Media Studio, operating at addresses in Istanbul and Balıkesir, as the data controller.
2. Personal Data We Process
The personal data processed during our service processes are as follows:
- Identity Information: First name, last name.
- Contact Information: E-mail address, phone number, billing and delivery address.
- Customer Transaction Information: Purchased package/service details, requests and complaints, project details, invoice and payment records.
- Transaction Security and Analytics Data: IP address, site login/logout records, cookie data.
3. Purposes for Processing Personal Data
Your personal data is processed in accordance with the conditions set out in Articles 5 and 6 of the KVKK for the following purposes:
- Establishing contract processes, preparing quotations, and performing services.
- Issuing invoices, and tracking accounting and finance processes.
- Customer relationship management, after-sales support, and technical maintenance processes.
- Evaluating and resolving users' requests, suggestions, and complaints.
- Fulfilling legal obligations and responding to information requests from official authorities.
- Ensuring website security and resolving technical errors.
4. Transfer of Personal Data
The personal data collected may be transferred, in accordance with Articles 8 and 9 of the KVKK and for the purposes stated above, to:
- Domestic and/or international infrastructure and server (hosting) providers with whom we collaborate in delivering our services,
- E-invoice/e-archive integrators and our financial advisors,
- Licensed payment service providers (such as Iyzico) for the secure processing of payments,
- Authorized public institutions and judicial authorities to fulfill our legal obligations.
5. Method of Collection and Legal Basis for Processing
Your personal data is collected through wholly or partially automated means via contact forms, price quote forms, cookies, e-mail correspondence, and digital channels such as WhatsApp on our website. The legal bases for processing your personal data are:
- Being directly related to the establishment or performance of a contract (KVKK Art. 5/2-c): The necessity of processing your data to provide services and prepare quotations for you.
- Fulfillment of the data controller's legal obligation (KVKK Art. 5/2-ç): Our obligation to issue invoices and maintain records in accordance with tax laws and relevant legislation.
- Being mandatory for the legitimate interests of the data controller, provided that the fundamental rights and freedoms of the data subject are not harmed (KVKK Art. 5/2-f): Ensuring the security of our website and improving our service quality.
6. Your Rights Under the KVKK (Article 11)
Pursuant to Article 11 of the KVKK, as a data subject you have the following rights:
- To learn whether your personal data is being processed,
- To request information if your personal data has been processed,
- To learn the purpose of processing your personal data and whether it is being used in accordance with its purpose,
- To know the third parties to whom your personal data has been transferred, domestically or abroad,
- To request the correction of your personal data if it has been processed incompletely or inaccurately,
- To request the deletion or destruction of your personal data within the conditions stipulated in the KVKK,
- To request that correction, deletion, and destruction transactions be notified to the third parties to whom your data has been transferred,
- To object to a result arising against you through the analysis of processed data exclusively by automated systems,
- To claim compensation for damages in the event that your personal data is processed unlawfully.
