2. Intellectual and Industrial Property Rights

  • All design elements, graphics, texts, code, videos, logos, and all digital assets under the ON Media brand featured on this website are the intellectual property of ON Media Studio. Partial or full copying, reproduction, distribution, or publication in other media without written permission is prohibited.
  • The copyright and usage rights for website designs and code files developed exclusively for our clients are transferred to the client upon full payment of the project fee. However, the intellectual property rights of general code libraries, ready-made templates, and infrastructure modules owned by our Agency and used in these projects remain with our Agency; they cannot be transferred to the client or sold to third parties.

3. Limitation of Liability and Disclaimer

  • Third-Party APIs and Integrations: Our Agency cannot be held responsible for disruptions, delays, or data losses arising from the servers, updates, or technical outages of third-party integrations used in our software (marketplace APIs such as Trendyol, Hepsiburada, virtual POS payment systems, maps, and Google services).
  • Client Content: The copyright and legal validity of all images, photographs, videos, logos, and commercial texts provided to us by our clients for use in software development or social media management processes belong to the client. Our Agency bears no supervisory obligation regarding the accuracy or copyright compliance of such content.
  • Server and Hosting Outages: Our Agency has no legal liability for data loss or access disruptions arising from hardware failures, cyber-attacks, network outages, or force majeure events on the hosting/server infrastructure (AWS, Vercel, Hetzner, local data centers, etc.) where client websites are hosted.
  • Performance and Revenue Guarantee: SEO work, social media designs, and websites provided by our Agency are prepared to support the client's business volume. However, no guarantee of specific revenue, conversion rate, or search ranking is given due to changes in search engine algorithms, market dynamics, or client sales policies.

Our website may contain links to other websites for reference purposes or to introduce third-party services. We have no control over or responsibility for the content, privacy policies, or security measures of these external sites.

5. Amendments and Validity

Turkish Law shall apply to the resolution of any disputes arising from the implementation or interpretation of this legal information and terms of use, and the Courts and Enforcement Offices of Istanbul (Avcılar) and Balıkesir (Karesi) shall have jurisdiction.
